1. Agreement to terms
These Terms of Service (“Terms”) govern your access to and use of the website applib.dev and the software, products, and services offered by Noaa AB (“we”, “us”, “our”), including our apps and this website. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you may not use our services. We may modify these Terms from time to time; the “Last updated” date will be revised. Your continued use after changes constitutes acceptance of the updated Terms.
2. Use of the service
You may use our services only for lawful purposes and in accordance with these Terms. You agree not to: (a) violate any applicable law or regulation; (b) infringe our or any third party’s intellectual property or other rights; (c) attempt to gain unauthorized access to our systems, networks, or other users’ data; (d) reverse engineer, decompile, or disassemble our software except to the extent permitted by applicable law; (e) resell, sublicense, or commercially exploit our services or software except as we expressly allow; or (f) use our services to build a competing product or service. We may suspend or terminate your access for breach of these Terms or for any other reason we deem necessary.
3. License
Subject to your compliance with these Terms and payment of any applicable fees, Noaa AB grants you a limited, non-exclusive, non-transferable license to use our software for your personal or internal business use, in accordance with the license type you purchased (e.g. single-device or as specified at purchase). You may not copy, modify, or create derivative works of the software except as we expressly permit. All rights not granted herein are reserved by Noaa AB.
4. Payment and refunds
Fees for paid products (such as software licenses) are as stated at checkout. Payment is due when you complete your purchase. We use third-party payment processors (e.g. Stripe); their terms apply to payment processing. Refunds are handled in accordance with our refund policy and applicable law. We may offer refunds for defective or undelivered products. Chargebacks or refunds may result in revocation of your license.
5. Termination
You may stop using our services at any time. We may suspend or terminate your access or license if you breach these Terms or for operational or legal reasons. Upon termination, your right to use the services and software ends; you must cease use and uninstall the software where applicable. Provisions that by their nature should survive (including governing law and limitation of liability) will survive termination.
6. Disclaimers
Our services and software are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure.
7. Limitation of liability
To the maximum extent permitted by applicable law, Noaa AB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claims arising from or related to these Terms or the services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
8. Governing law and disputes
These Terms are governed by the laws of Sweden, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the services shall be subject to the exclusive jurisdiction of the courts of Sweden. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
